USTR Begins Granting China 301 Exclusions

Date: January 8, 2019

In the Dec. 28 Federal Register, USTR published a list of product exclusions for the $34 billion tranche of tariffs on Chinese goods. The list includes seven 10-digit HTS codes that are excluded and an additional 24 specific product descriptions narrower than the 10-digit HTS code. All products receiving exclusions fall within HTS Chapters 84, 85, and 90. These HTS codes reflect almost 1,000 exclusion requests.

Even if your company did not submit an exclusion request for these codes, if you import goods from China covered by these codes or product descriptions, you are eligible for an exclusion. The exclusions are retroactive to July 6, 2018 and extend through December 28, 2019.

According to USTR, additional decisions on product exclusion requests will be announced periodically. To view the Federal Register Notice, click here. To view the updated index of product exclusions requests, click here.
